General terms
These Terms of Use are an agreement between you and Sole proprietor (FOP) Kudla Maksym Valentynovych (hereinafter “we”). They govern your access to matcha.wedding, the wedding websites created on it, the couple’s dashboard and other related services and tools (hereinafter the “Services”).
Please read these Terms carefully before using the Services. By using the Services, you accept these Terms and the Privacy Policy, which is incorporated into them by reference. If you do not agree with the Terms or the Privacy Policy, you must not use the Services.
Use of the Matcha Events marketplace (matcha.events) is governed by its own terms.
What Matcha Wedding is
Matcha Wedding lets couples create a website for their wedding: an invitation with the couple’s story, the date, venue and schedule of the day, guest replies, a shared album of guest photos, a wish list, links for money gifts and a “Wedding team” with their vendors. matcha.wedding also has a catalog of wedding vendors.
Matcha Wedding is an information product. We do not organize weddings, do not employ vendors and are not a party to arrangements between the couple, their guests and vendors. The couple makes arrangements with a vendor directly.
Access to the Services and your account
We reserve the right, at our sole discretion and without notice, to change the Services or discontinue any of their features. We are not liable if all or any part of the Services is unavailable at any time or for any period.
You need an account to create a site. All information you provide must be accurate, current and complete. Keep your sign-in details secret, do not give anyone else access to your account and notify us immediately of any unauthorized access.
We may disable an account or restrict access to the Services if, in our opinion, you have violated these Terms.
You may use the Services only for lawful purposes and in accordance with these Terms. You must not attempt to gain unauthorized access to the Services, servers or databases, or disrupt their operation.
Roles: Owner, editors and Providers
- The Owner is the person who created the wedding event and its site. The Owner chooses and pays for the package, turns modules on, invites editors and is responsible for the site and for the guest data the site collects.
- Editors are people the Owner invites (for example, the other half of the couple). They can change the site’s content and see guest replies. The Owner is responsible for the actions of the editors they invite.
- Providers are Matcha Events vendors (for example, planners or agencies) who can create an Event themselves and invite the couple to it. Such an Event belongs to the Provider, its modules are covered by the Provider’s plan and the couple buys nothing; the couple gets access to the Event’s modules only.
- Guests are visitors to the wedding website who reply to the invitation, upload photos or reserve gifts. Guests do not need an account for this.
Packages and payment
A site can be created for free. More features come in packages bought once per wedding (one Event); they are not subscriptions:
- Free — 0 UAH;
- Standard — 599 UAH;
- Premium — 1,199 UAH.
What each package includes (modules, photo storage, how long the site lives after the wedding, designs, branding) is stated on matcha.wedding. The price and contents of a package at the time of payment apply.
Payments are accepted by a third-party payment provider. We do not receive or store your full card details. A package applies to the Event it was bought for and cannot be moved to another one.
For refunds, write to support@matcha.wedding. Requests are handled in accordance with the laws of Ukraine.
How long a site lives and data deletion
After the wedding date the site works for 7 days (Free), 30 days (Standard) or 90 days (Premium). After that the site and its data — guest photos, guest replies, the wish list and reservations — are deleted permanently.
The Owner is responsible for saving the data they need in time.
The couple’s content and guest photos
The couple is responsible for everything they publish on the site: texts, photos, names and other data. Publish only what you have the rights to, and other people’s data only with their consent. You grant us the right to store, process and display this content to the extent needed to run the Services.
Guests can upload photos to the shared album. Other guests of the site see uploaded photos at once. By uploading a photo, a guest confirms that they have the rights to it and that it does not break the law or anyone’s rights. The Owner and editors can hide or delete any photo.
We may remove content or restrict a site if the content violates these Terms or the law, or upon a lawful request.
Guest data
The site collects from guests what the couple has chosen: invitation replies, names, party size, wishes and answers to the couple’s questionnaire. The couple decides which questions to ask and is responsible for collecting and using this data lawfully and only to prepare for the wedding. We process this data to provide the Services, as described in the Privacy Policy.
Wish list and gifts
Guests can reserve gifts from the wish list. The couple sees that a gift is reserved, and the guest’s name (if the guest left it) only after the wedding.
Matcha Wedding does not accept payments for gifts. Links for money gifts lead to third-party services, and we are not a party to such transfers.
Safety and prohibited conduct
You must not use the Services for unlawful activity, harassment, discrimination, threats, fraud, publishing other people’s personal data without consent, or content that violates the rights of others.
We may investigate complaints and remove content, restrict features, or suspend or close accounts and sites to protect users, guests and the Services.
Intellectual property rights
The Services and all their content, features and design (including software, texts, images and site designs, and their selection and arrangement), except the content of couples and guests, are owned by the Company, its licensors or other providers of such material and are protected by the laws of Ukraine and international intellectual property laws.
Links
If the Services contain links to other sites and resources provided by third parties (including vendor sites and money gift services), these links are provided for your convenience only. We have no control over these resources and are not responsible for their content, availability or privacy practices. You visit them at your own risk.
Disclaimer of warranties
THE SERVICES AND THEIR CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, RELIABLE, UNINTERRUPTED OR FREE OF ERRORS OR HARMFUL COMPONENTS, OR THAT THEY WILL MEET YOUR NEEDS.
TO THE EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS CONTRACTORS ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE SERVICES, INCLUDING THE LOSS OF DATA NOT SAVED BEFORE A SITE’S LIFETIME ENDS AND THE ACTIONS OF VENDORS AND GUESTS.
Indemnification
You agree to defend, indemnify and hold harmless the Company, its licensors and service providers from any claims, damages and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, the content you posted or your use of the Services.
Reporting violations and disputes
To report a violation, inappropriate content or an incident related to the Services, write to support@matcha.wedding with a link to the site and the details you have.
To the maximum extent permitted by law, disputes related to these Terms or the use of the Services are governed by the laws of Ukraine and resolved by the courts of Ukraine having jurisdiction.
Changes to the Terms
We may update these Terms. Changes take effect once published on this page, and the version date is shown at the top. Your continued use of the Services means you accept the changes. Changes do not worsen the price or contents of a package you have already paid for.
Entire agreement
These Terms together with the Privacy Policy constitute the entire agreement between you and the Company regarding the Matcha Wedding Services and supersede all prior arrangements regarding them.
